This is the inaugural edition of the AiGovOps Foundation's semi-annual Healthcare AI Governance report. Every six months, we will publish a practitioner-facing deep dive into where the field actually stands. This isn't where vendors claim it is, nor where policy briefs imagine it to be: it is a reflection of where the engineers, CDOs, CMIOs, and compliance leads we talk to are spending their nights worrying.

This content was generated by our team’s research and active discussion across our AiGovOps community members. In fact, our April 1 Affinity Group meetup at AI House in Seattle focused specifically on AI governance in the healthcare sector. The room was small on purpose: small enough that a CTO from a 22,000-person health products company could sit across from the founder of a runtime attestation startup and argue about whether cryptographic proof is a feature or a distraction. It was small enough that when the news broke mid-session that Colorado had just softened its AI Act, the entire room had to reset its mental model of the regulatory map in real time.

That kind of conversation doesn't fit on a slide. It fits here, in our semi-annual community report out.

Our working thesis for these reports stays constant: shipping trust without sacrificing velocity. At the AiGovOps Foundation, we believe this is accomplished through the development and implementation of breakthrough AI governance framework technologies to automate and enforce responsible, ethical, safe, and compliant AI solutions. We call this governance as code: the transition from static PDF policies to executable, real-time guardrails.

The Rundown : Q1 2026 in AI Governance

Every issue opens with a compact rundown of the stories that most shaped the governance conversation in the preceding quarter. This is not a news digest; it is a curated set with the "so what" attached for the modern practitioner.

Anthropic’s "Double Leak" Irony

Anthropic leaked its own Claude Code source: twice in one week. On March 26 and again on March 31, Anthropic accidentally shipped 512,000 lines of Claude Code's full source code to the public npm registry via a misconfigured debug file. This included 1,906 TypeScript files, 44 hidden feature flags, and the complete agentic architecture. Most concerning was the disclosure of a 29–30% false claims rate in their latest iteration.

The governance read: the self-described "safety-first AI lab" couldn't configure its own release flag. Every CDO using Claude Code in their stack now has to decide whether this leak is a security exposure to mitigate or an open-source audit opportunity to exploit. This highlights the urgent need for ML governance that tracks not just the model, but the release pipeline itself.

The Death of Sora and the "Zombie Algorithm"

On March 25, OpenAI shut down its Sora video generator entirely: mobile app, API, everything: to redirect compute toward their next major model. Less than 18 months after the Sora 2 launch, it was deemed a "drag on resources."

The practitioner takeaway: your procurement contract is not as durable as you think it is. The "zombie algorithm" problem in healthcare: paying for models that degrade as your population shifts: now has a provider-side parallel. Organizations must ask their vendors what happens to clinical workflows when a provider pivots their compute economics.

Regulatory Whiplash: Colorado and the Trump Framework

The Colorado AI Act was materially softened just as the Trump administration's National Policy Framework called for federal preemption of state AI laws and limited developer liability. However, federal preemption remains legally contested.

AI compliance uncertainty is real, but it is not actionable as a waiting strategy. Organizations that wait for absolute clarity will accumulate substantial unmanaged exposure. As we often discuss in our 90-day compliance roadmap, state obligations still exist, and deployment decisions continue regardless of the legislative gridlock.

The Pressure to Ship vs. The Capacity to Secure

A TrendAI study of 3,700 decision-makers found that 67% of respondents felt pressured to approve AI despite known security risks. Furthermore, only 44% of senior leaders had even a moderate understanding of the legal frameworks governing AI. This is shadow AI at enterprise scale. It is the single strongest argument for why AiGovOps must be treated as an operational discipline rather than a policy exercise.

The Inflection Point : Healthcare AI Crosses the Threshold

Healthcare AI crossed a visible threshold at HIMSS26. The market conversation moved decisively from experimentation to scaled deployment. Microsoft expanded Dragon Copilot partnerships, Amazon extended Health AI beyond One Medical, and Oracle rolled out clinical AI agents for emergency documentation.

Critically, Epic disclosed that more than 85% of its customers are now actively using Epic AI. AI is no longer a pilot at the margin; it is the operational baseline. To manage this at scale, organizations are turning to the NIST AI RMF as a foundation for their internal controls.

This diagram illustrates the convergence of these disciplines. To ship trusted AI, healthcare systems must integrate FlowOps and AiGovOps into their existing MLOps and DevOps pipelines. This "flow-to-trust loop" is how the industry will bridge the gap between innovation and safety.

Three Proof Points

Three independent signals converged in Q1 2026 to prove that governance as code is the new operational target:

  1. ARPA-H ADVOCATE: This chronic cardiovascular disease program includes a "supervisory agent" as a co-equal technical workstream. It’s an always-on technical subsystem monitoring behavior and generating evidence for regulatory trust. The federal government is treating continuous oversight as a build requirement, not a retrospective check.

  2. Mount Sinai’s Multi-Agent Study: Research published in npj Health Systems showed that single-agent designs are a liability at scale. Multi-agent systems maintained 90.6% accuracy under load, while single-agent systems suffered "catastrophic collapse" (dropping to 16.6% accuracy). If your architecture review doesn't account for this, your model governance is stale.

  3. Mass General Brigham’s Enterprise Model: MGB scales governance through infrastructure, not through memo volume. By providing safe, usable internal alternatives, they reduce shadow AI. Enablement produces compliance; restriction alone produces workarounds.

The 22% Auditability Problem

Roughly 22% of healthcare leaders can produce a defensible, regulator-ready explanation of an AI-assisted decision within 30 days. The other 78% cannot. This gap is the defining operational risk of 2026.

The Failure Landscape

ECRI ranked misuse of AI chatbots as the #1 health technology hazard for 2026. Documented failures include AI inventing body parts ("hallucinated anatomy") and dangerous electrosurgical guidance.

Furthermore, litigation is setting the standard. Discovery orders in cases like the UnitedHealth nH Predict litigation signal that courts treat algorithmic decision architecture as discoverable artifacts. If your workflow influences patient access to care, your responsible AI governance artifacts: audit trails and override documentation: are no longer optional.

The value of our affinity group is the candid conversation. Four themes emerged:

  • "Ferraris for People on Bicycles": We are mandating AI adoption while using a security stack designed for a pre-agentic world. We need proactive, agent-aware blocking that interprets intent in real time.

  • Meeting Healthcare Where It Is: Startups are learning that complex cryptographic attestation fails if the buyer hasn't even written a basic AI policy yet. We need on-ramps and diagnostic tools first.

  • The Human in the Loop is Already in Court: Courts are now defining "effective human oversight." If a physician reviews a claim in 1.2 seconds, the "human in the loop" is a legal fiction.

  • Case Law is the Regulation: With legislatures in conflict, plaintiffs' attorneys are writing the de facto standards through settlements. If you aren't reading the court filings, you aren't following the regulations.

The Five Questions : A 90-Day Practitioner Self-Assessment

Every healthcare AI program should be able to answer these five questions honestly:

  1. Inventory: Do you have a complete list of every AI system touching your workflows, including shadow AI?

  2. Identity: What credentials does each agent operate under, and who can revoke its access in real time? (See our post on NIST’s framework for AI credentials).

  3. Architecture: Does your design reflect the multi-agent necessity for clinical-scale load?

  4. Monitoring: What post-deployment metrics exist for safety signals and clinician override patterns?

  5. Evidence: Can you produce a defensible explanation of an AI outcome within 30 days?

Shipping Trust Without Sacrificing Velocity

The evidence from Q1 2026 is clear: healthcare doesn't just need more governance; it needs the right kind. Static committees are too slow for agentic, rapidly iterating systems. The winners of this inflection point will be the organizations that treat governance as an engineering discipline.

AI without governance is just expensive prototyping. Governance without velocity is just expensive bureaucracy. Everything we do at the AiGovOps Foundation lives in the space between those two failure modes.
